General Terms and Conditions of Sale (GTC) – Customers
Article 1 – Purpose
These General Terms and Conditions of Sale (GTC) govern the relationship between Furzo, a platform connecting artists and buyers of products at furry, and customers who use the platform to make purchases.
Article 2 – Definitions
- Furzo : The platform that connects artists with buyers of furry products, available at https://test.furzo-marketplace.com/.
- Client : Any individual or legal entity using the Furzo platform to purchase products.
- Artist : Any individual or legal entity using the Furzo platform to sell products.
- Product : Any good or service offered for sale on Furzo by an artist.
- Order : An agreement whereby the customer agrees to purchase a product through Furzo.
Article 3 – Acceptation des CGV
Any order placed on the Furzo platform constitutes unconditional acceptance of these Terms and Conditions.
Article 4 – Produits
- The products offered on Furzo are artistic services (creation of commissioned works) or cultural and artistic goods (prints, merchandise, digital files).
- Furzo acts as a technical intermediary, facilitating the connection between the parties and ensuring the security of the financial transaction related to this artistic commission.
Article 5 – Commande
- Customers can place an order by following the instructions provided on the platform.
- An order is final once full payment has been made.
- For technical and transaction security reasons, only one “Commission” product can be added to the cart at a time, and it cannot be combined with other standard products in the same order
5.1 Artist Approval for Customized Products
- Once the Customer has made the payment, the order is placed on hold pending confirmation. The Artist has 6 days to accept the order.
- If the Artist accepts: The order changes to “In Progress” status, and work begins.
- If the Artist refuses or does not respond within 6 days: The order is automatically canceled, and the Customer receives a full refund at no cost.
Article 6 – Price
- Prices are listed in euros, including all taxes.
- Shipping costs are displayed before the order is confirmed.
Article 7 – Paiement
Orders can be paid for by credit card (via Stripe).
7.1 Escrow of Funds
Payment for orders is made by credit card through the secure payment service provider Stripe. Payment for orders is made by credit card through the authorized payment service provider Stripe. Stripe ensures the security of funds and acts as an escrow agent. When a product is paid for, the amount is charged to the Customer and securely held by Stripe. Furzo merely transmits the technical instruction to Stripe to release the funds to the Seller once the order is marked as “Completed.”
7.2 Price Adjustment
During the fulfillment of the order (particularly for custom orders), the initial price may be subject to change in consultation with the Customer:
- Surcharges: If the final price set by the Artist exceeds the initial bank authorization, the initial payment is canceled and a new payment request for the new amount is sent to the Client
- Partial Refunds: If the service is scaled back or partially canceled by mutual agreement, a partial refund will be credited to the Customer’s original payment method.
Article 8 – Delivery and Shipping via Furzo
8.1. Shipping Terms The Furzo platform simplifies shipping management by providing Artists (Sellers) with prepaid shipping labels. However, the Artist remains solely responsible for physically preparing the package, packing it, and handing it over to the carrier.
8.2. Cost and Shipping Fees : Shipping costs are calculated automatically at the time of order based on the weight and dimensions provided by the Artist, including the carrier’s fees, the platform’s handling fees, and, if applicable, insurance to the value for orders over €150.
8.3. Delivery Times (Manufacturing + Shipping) The total delivery time consists of two distinct phases:
Production and processing time: For in-stock items, shipping usually takes 48 to 72 hours. For custom orders (commissions), the Customer must refer to the production time specifically indicated by the Artist on the product page or in the Artist’s own Terms of Sale. The Artist is solely responsible for meeting this production deadline.
Delivery time: Once the product is ready and the order status changes to “Shipping,” the carrier’s delivery times apply (usually 3 to 5 business days, depending on the service selected).
8.4. Shipping Obligation Once the order is ready and the shipping label has been generated by the Artist, the Artist has a maximum of 7 calendar days to hand the package over to the carrier. Furzo cannot be held responsible for delays caused by the Artist’s production process or by unforeseen circumstances during shipping.
8.5. Monitoring and Acceptance The Customer will receive a tracking number as soon as the package is picked up by the shipping carrier. If a package is damaged upon receipt, the Customer must file a written claim with the carrier or refuse the package, and notify the Artist via the internal messaging system within 48 hours to allow for the filing of an insurance claim.
8.6 Order Completion (Funds Released) For physical products, the order is considered complete upon confirmed receipt or after the shipping deadline has passed. For digital services and commissions, the Artist marks the order as “Complete” once the files have been delivered. This action triggers the release of the escrowed funds to the Artist’s account. In the event of a confirmed failure to deliver, the Client may report the dispute to Furzo to obtain a refund of the escrowed funds.
Article 9 – Right of Withdrawal
In accordance with the law, the customer has fourteen (14) days from the date of receipt to exercise their right of withdrawal without giving a reason and without incurring any penalties.
- Written notification to the artist (via email or regular mail).
- The product must be returned in its original packaging, in perfect condition, within 14 days of cancellation. The customer is responsible for return shipping costs.
- The artist will issue a refund within 14 days of receiving the returned item.
IMPORTANT EXCEPTION – Custom Orders and Digital Content: In accordance with Article L.221-28 of the Consumer Code, the right of withdrawal CANNOT be exercised for:
- Products made to the customer's specifications or significantly personalized (e.g., custom artwork, personalized badges, YCH).
- The supply of digital content not provided on a physical medium (immediate download) for which performance has begun after the consumer’s prior consent and express waiver of their right of withdrawal.
By confirming an order of the “Commission” or “Digital Download” type, the Customer expressly waives their right of withdrawal as soon as the Artist has begun work or the file has been downloaded.
Article 10 – Statutory Warranties
The customer is covered by the statutory warranties of conformity and against hidden defects, which are valid for two years:
- Warranty of Conformity : Product does not match the description or meet reasonable expectations.
- Warranty against hidden defects : A pre-existing, non-visible defect that renders the product unsuitable for its intended use. In the event of a problem, the customer should contact the artist to reach an amicable resolution (repair, replacement, or refund).
Article 11 – Dispute Resolution
- The parties agree to seek an amicable resolution through the internal messaging system on Furzo.
- If no agreement is reached, the matter may be referred to Furzo to review the transactions on the platform and attempt to reach a fair resolution.
Article 12 – Liability of Furzo
Furzo is an intermediary and not a party to the sales contracts. Furzo’s liability is limited:
- The platform's reliability.
- The amount of commissions charged for the relevant transactions, or a prorated amount based on the subscription plan selected for artists eligible for a commission-free offer
- Delayed or missed delivery.
- Non-compliant products.
- Technical issues or external disputes.
Article 13 – Intellectual Property
The content of Furzo (logos, text, images, etc.) is protected. Any reproduction or modification is prohibited without prior authorization.
Article 14 – Personal Data
Furzo collects and processes personal data in compliance with the GDPR:
- Purposes: Account creation, order management, communication.
- Rights: Access, correction, deletion, restriction. Contact Furzo to exercise these rights.
Article 15 – Governing Law and Jurisdiction
These Terms and Conditions are governed by French law. The French courts shall have exclusive jurisdiction in the event of a dispute.
Article 16 – Term and Amendments
- These Terms and Conditions take effect on February 1, 2024, for an indefinite period.
- Furzo reserves the right to modify them. Customers will be notified by email or notification.
Article 17 – Notifications
Customers should review the Terms and Conditions regularly to stay informed of any changes. Notifications will be sent via email or posted on the Furzo platform.
Article 18 – External Links and Affiliate Products
Furzo may allow artists to offer “third-party/affiliate products” on the platform. These products are sold outside of Furzo, and the artist redirects customers to an external website to complete the purchase.
Furzo is not responsible for the content, products, services, or practices of external websites to which artists may direct customers.
The purchase of third-party products or affiliate products is the sole responsibility of the customer and the artist in question. Furzo cannot be held liable in the event of a dispute, payment issue, delivery problem, or product non-conformity.
It is the customer's responsibility to review the terms and conditions and privacy policy of the external website before making a purchase.
